1. Introduction

These Terms and Conditions ("Terms") govern your use of the Mealiv website and web application ("the Service") operated by Digital Ideation Limited, a company registered in England and Wales (Company No. 17059030) ("we", "our", "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Service.

1A. International Use

The Service is operated from the United Kingdom. We make no representation that the Service is appropriate or available for use in other locations. Users who access the Service from outside the UK do so at their own risk and are responsible for compliance with local laws.

Nothing in these Terms shall deprive you of any mandatory consumer protections under the laws of your country of residence.

2. The Service

Mealiv is a digital meal planning and health platform providing:

• Nutritional information and product search
• Tools to create and import recipes, plan, manage and buy household food and drink
• AI guidance and information to assist meal planning and health activities
• Health monitoring and tracking tools covering exercise, nutrition and dietary compliance

3. Account Registration

• You must be at least 16 years old to create an account
• You must provide accurate and complete information when registering
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Free and Premium Services

4.1 Free Tier

The core features of Mealiv are available free of charge, including product search, meal building, cookbook, and shopping lists.

4.2 Free Trial

We offer a 14-day free trial of Pro features. The trial begins automatically when you create an account — no payment details are required. After the trial ends, your account will revert to the Free plan. You can upgrade to a paid plan at any time during or after the trial. Each user is limited to one free trial.

4.3 Premium Subscription

• Premium features (such as the Meal Planner) are available via a paid subscription
• Payments are processed securely by Stripe
• Subscription prices are displayed at the time of purchase and may be updated with reasonable notice
• Subscriptions renew automatically unless cancelled before the renewal date
• All prices are displayed in GBP (£). Currency conversions shown at checkout are for convenience only and may vary depending on your payment provider

4.4 Cancellation and Refunds

• You may cancel your premium subscription at any time from your account settings
• Upon cancellation, you retain access to premium features until the end of the current billing period
• Refunds are handled in accordance with the Consumer Rights Act 2015. If you believe you are entitled to a refund, please contact us within 14 days of purchase
• If you are a consumer in the European Economic Area, you may have a legal right to cancel your subscription within 14 days of purchase. By purchasing and accessing digital content immediately, you acknowledge that you may lose this right

5. User Content

5.1 Ownership

You retain ownership of all content you create on the Service, including meals, recipes, shopping lists, and meal plans ("User Content"). By using the Service, you grant us a limited licence to store, display, and process your User Content solely for the purpose of providing the Service to you.

5.2 Acceptable Use

You agree not to use the Service to:

• Upload content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity
• Attempt to gain unauthorised access to the Service or other users' accounts
• Use automated tools (bots, scrapers) to access the Service without our permission
• Interfere with or disrupt the Service or its infrastructure

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms, without prior notice.

6. Third-Party Data and Services

6.1 Third-Party Data

The Service uses data provided by third-party sources, including food product databases, recipe providers, and other external content services.

While we strive to ensure data accuracy, we do not guarantee that any third-party data is complete, current, or error-free. Such data is provided for informational purposes only.

6.2 Third-Party Content

The Service may display or integrate content from third parties, including images, recipes, and videos. This content is provided for convenience and remains the intellectual property of its respective owners.

We do not control third-party content and accept no responsibility for its accuracy, legality, or availability.

6.3 External Services

Certain features of the Service may rely on third-party services (for example, payment providers or embedded media platforms). Your use of these features may also be subject to the terms and policies of those third parties.

6.4 Imported Content

By using the import feature, you acknowledge that:

• Imported content remains the intellectual property of the original author or rights holder
• We store imported content solely to provide personal functionality within your account
• You are responsible for complying with applicable copyright laws and the source website's terms
• We accept no liability for misuse of imported content

If you are a rights holder and believe your content has been used improperly, please contact us and we will take appropriate action.

7. Nutritional Information Disclaimer

• We do not guarantee the accuracy of nutritional information, allergen data, or dietary classifications (e.g. vegan, gluten-free)
• Dietary flags and scores (NutriScore, NOVA, Eco-Score) are provided by third-party databases and may not reflect the most current product formulations
• Always check product packaging for the most up-to-date information, particularly regarding allergens

8. AI Features

• Mealiv uses artificial intelligence ("AI") to provide features including, but not limited to, meal suggestions, food logging assistance, nutrition insights, recipe recommendations, and automated meal plan generation
• AI features are available to subscribers on Pro and Power plans. Free trial users receive a limited number of AI interactions during the trial period
• AI usage is subject to fair use limits, which may vary by subscription tier and may be adjusted from time to time at our discretion. Current usage allowances for each subscription tier are displayed on our pricing page and remaining AI credits available to subscribing users are displayed on every page
• AI-generated content, including nutritional estimates, meal suggestions, and health insights, is provided for informational purposes only and should not be treated as medical, dietary, or nutritional advice
• While we strive for accuracy, AI-generated results may be inaccurate, incomplete, or inappropriate. You should always verify nutritional information and consult a qualified healthcare professional before making dietary changes based on AI suggestions
• We do not guarantee the availability, accuracy, or reliability of AI features and may modify, limit, or discontinue them at any time without prior notice
• We may use anonymised and aggregated usage data to improve our AI features and the overall Service. We will not share your personal data with third-party AI providers for their own training purposes

9. Intellectual Property

• The Mealiv name, logo, design, and original content are our intellectual property
• The Service's source code, design, and features are protected by copyright
• You may not copy, modify, distribute, or create derivative works based on the Service without our written permission

10. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided "as is" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
• Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or £100 if you are a free user)
• Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law

11. Availability and Modifications

• We aim to keep the Service available at all times but do not guarantee uninterrupted access
• We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice
• We will make reasonable efforts to notify you of significant changes that affect your use of the Service

12. Account Termination

• You can delete your account upon request by emailing [email protected]
• We may suspend or terminate your account if you breach these Terms
• Upon account deletion, your personal data and User Content will be permanently removed in accordance with our Privacy Policy

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service or by email. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
